Qualified Applicant

Under Texas Law birth records are confidential for seventy-five (75) years and death records are confidential for twenty-five (25) years and can be obtained only by qualified applicants.

A qualified applicant, which is defined by the Texas Administrative Code Section 181.1(13) as being, the registrant, his or her guardian, or the children, spouses, parents, siblings, or grandparents of the registrant. Applicants who are not immediate family members must provide legal documentation (such as a court order establishing guardianship) that demonstrates a direct, tangible interest in the birth certificate.
