Levels of Enforcement

Violations trigger Enforcement Actions.  There are various levels of enforcement.  Severity of a violation determines the level of enforcement.
Level A Violations Enforcement:
A Phone call from the Pretreatment Program is generated, requesting information.

Level B Violations Enforcement:
A certified letter is generated from the pretreatment program containing a notification of violations.

Level C Violations Enforcement:
A letter from the Pretreatment Program is generated, including a notification of violations, and requesting voluntary compliance, compliance schedules, or meetings.

Level D Enforcement
Level D violators will be requested to arrange an informal meeting to discuss all violations.  The meeting may result in a formal written compliance schedule or an administrative order.
Administrative orders will be structured depending on results of meeting.  Administrative orders may contain involuntary compliance schedules and/or fines.  Fines will range from a minimum of one dollar ($1.00) to a maximum of One Thousand ($1,000.00) per violation per day.
An Administrative Order will contain a statement that failure to comply will result in additional fines and/or termination of service.
An Administrative Order will also contain a statement that reserves the right of the City to recover damages caused to physical plant, and/or penalties imposed by any State or Federal Agency due to these violations.
Any user who meets the definition of significant noncompliance will have the firm name published annually in the newspaper as a violator of local, state and federal law.
Level E Enforcement
An Administrative Order structured to the needs of the City, and containing fines of $2,000 per day per violation.
An Administrative Order will contain a statement that reserves the right of the City to recover damages caused to the physical plant, and/or penalties imposed by any State or Federal Agency due to these violations.
